NOTICE OF ADOPTION OF THE SULLIVAN TOWNSHIP GENERAL ORDINANCE

 

PLEASE TAKE NOTICE that a Sullivan Township Ordinance titled Ordinance Addressing Floodplain Management Provisions of the State Construction Code was adopted at a regular meeting of the Sullivan Township Board held on January 4, 2022.  The ordinance is to take effect on MARCH 15,2022. The Ordinance Addressing Floodplain Management Provisions of the State Construction Code follows in its entirety.

ORDINANCE ADDRESSING FLOODPLAIN MANAGEMENT PROVISIONS OF THE STATE CONSTRUCTION CODE

AN ORDINANCE TO ADOPT THE GENERAL ORDINANCE TO DESIGNATE REGULATED FLOOD HAZARD AREAS, TO AUTHORIZE THE ENFORCING AGENCY TO ENFORCE APPENDIX G OF THE MICHIGAN BUILDING CODE, UNDER THE PROVISIONS OF THE STATE CONSTRUCTION CODE ACT, ACT NO. 230 OF THE PUBLIC ACTS OF 1972, AS AMENDED.

THE TOWNSHIP BOARD OF SULLIVAN TOWNSHIP, MUSKEGON COUNTY, MICHIGAN, ORDAINS:

Section 1.  AGENCY DESIGNATED.  Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, the Building Official of the Township of Sullivan is hereby designated as the enforcing agency to discharge the responsibility of the Township of Sullivan under Act 230, of the Public Acts of 1972, as amended, State of Michigan.  The Township of Sullivan assumes responsibility for the administration and enforcement of said Act throughout the corporate limits of the community adopting this ordinance.

Section 2.  CODE APPENDIX ENFORCED.  Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, Appendix G of the Michigan Building Code shall be enforced by the enforcing agency within the jurisdiction of the community adopting this ordinance.

Section 3.  DESIGNATION OF REGULATED FLOOD PRONE HAZARD AREAS.  The Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS) Entitled “Flood Insurance Study for Muskegon County, All Jurisdictions” and dated October 7, 2021 and the following Flood Insurance Rate Map(s) (FIRMS) panel number(s) 26121CINDOB, effective October 7, 2021 and 26121C0285D, 26121C0305D, 26121C0320D, 26121C0435D, effective July 6, 2015 are adopted by reference for the purposes of administration of the Michigan Construction Code, and declared to be a part of Section 1612.3 of the Michigan Building Code, and to provide the content of the “Flood Hazards” section of Table R301.2(1) of the Michigan Residential Code.

Section 4  REPEALS.  All ordinances inconsistent with the provisions of this ordinance are hereby repealed.

Section 5.  EFFECTIVE DATE.  That the foregoing addition to the Sullivan Township General Ordinances was approved and adopted by the Township Board of Sullivan Township, Muskegon County, Michigan, on January 4,2022. This Ordinance shall take effect immediately on publication of the Ordinance addition, which date of publication is March 15,2022.
